Since the legal aid fund is not limited, this means that we never have to deny legal aid to anyone because there is no more money to pay for their case. The UK government announced the formal ratification of the Council of Europe Convention on preventing and combating violence against women and domestic violence, also known as the Istanbul Convention, in July 2022[19]. This governance and accountability framework sets out the overall framework within which we operate and sets out the key roles and responsibilities that underpin the relationship between us and the Scottish Government. As part of the implementation of the Task Force`s recommendations, a new Human Rights Act will be introduced in the Scottish Parliament during this parliamentary session. This will be an important and historic step on Scotland`s road to human rights. The Bill will implement a wide range of internationally recognised human rights belonging to every person in Scotland to the extent possible within the transferred jurisdiction and strengthen domestic legal protection by making them enforceable in Scottish law. For civil, criminal and children`s legal assistance, we apply the tests. The vision of the Scottish National Action Plan for Human Rights (“SNAP”) is a Scotland where everyone can live in human dignity.

SNAP was the first national action plan for human rights in part of the UK. It draws on the experience of other European and Commonwealth countries as well as on the guidelines of the United Nations and the Council of Europe[38]. It is unique in its efforts to be a platform for collaboration between government, public institutions, civil society and rights holders with lived experience. The Scottish Government has accepted the 30 progressive, bold and ambitious recommendations of the National Human Rights Leadership Working Group for a new framework for human rights in Scotland. The Working Group conducted more than fifty missions to gather views on a range of rights to support the development of these recommendations. This commitment has been underpinned by direct hearings of a wide range of key groups of rights holders who are rarely heard and key groups whose rights are currently least exercised. This work was supported by the Human Rights Consortium Scotland and the Scottish Human Rights Commission (SHRC). Under the Bill, public authorities – including health authorities, councils and the Scottish Government itself – would be required by law to respect the rights of children and young people. The bill would make it illegal for public bodies to act in a manner inconsistent with the rights of the Convention on the Rights of the Child (“requirements” in the bill), and children, youth and their representatives would be able to appeal to the courts to enforce their rights. The Bill would create a proactive culture of day-to-day accountability for children`s rights across all public services in Scotland and ensure that authorities take proactive steps to ensure that children`s rights are respected in their decision-making and service delivery.

The Open Government Partnership (“OGP”)[50] is a global partnership that brings together government reformers and civil society leaders to create action plans that make governments more inclusive, responsive and accountable. Scotland has been a member of OGP since 2016 and has developed three action plans so far. The Scottish Parliament enacts and amends laws – including criteria for the provision of legal aid. These tests are then applied to each individual case. Scotland`s third Action Plan on Open Government (2021-25)[55] was published in early 2022 and continues the theme of working with civil society to develop improved and innovative approaches to participation and transparency across government. These include commitments to fiscal openness and transparency, increasing participation in health and social services, strengthening public and civil society engagement for a just transition to open, accessible, net-zero data, and whole-of-government engagement.
